$418M PARIS CLUB DEBT: ORDER STOPPING DEDUCTION OF STATE GOVTS’ FUNDS STAYS

A Federal High Court in Abuja on Tuesday declined the request to lift its order halting the planned deduction of $418 million from state governments’ accounts by the Federal Government to settle some debt allegedly owed to some consultants in relation to the Paris Club refund.

The court had on November 5, issued the restraining order against the Federal Government after listening to the lawyer to the 36 states, Jibrin Okutepa (SAN) who moved an ex-parte application to that effect.

At the resumed hearing in the suit filed by the 36 states, challenging the propriety of the planned deductions, lawyers to some of the defendants, including Wole Olanipekun (SAN) and Olusola Oke (SAN), prayed the court orally to lift the restraining order.


Olanipekun and Oke argued that by the court’s practice direction, the restraining order, made ex-parte, ought to last beyond 14 days.

They urged the court to deem the said order as having expired and no longer in existence.


Responding, Okutepa fished out a copy of the enrolled order from his file and read from it, noting that the order was to subsist pending the determination of the plaintiffs’ pending motion for interlocutory injunction.


Okutepa proceeded to submit that until the motion for interlocutory injunction was decided, the interim order shall be in force and bidding on all parties.

Ruling, Justice Ekwo counselled parties in the matter to tread softly, adding that the matter will be diligently determined.

Justice Ekwo declined to lift the order as prayed by the lawyers to the defendants

Instead, the judge adjourned till December 13 for the hearing of all pending applications. He ordered that fresh hearing notices must be served on the parties.

Earlier, the judge granted the plaintiffs leave to regularise their processes that were filled out of time.

He also granted them permission to serve some of the defendants, who are yet to be served court processes, through substituted means.

The motions for regularisation and for substituted service, granted by the judge, were moved by Okutepa on behalf of the states.
